1. Who we are
Pulse ("the Service") is operated by Faycal Derouiche ("we", "us", "our"). By accessing or using the Service, you ("you", "the user") enter into a binding agreement with us.
2. Acceptance
By creating an account, accessing, or continuing to use the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
3. Description of service
Pulse is an AI-powered analytics and operations dashboard for COD (cash-on-delivery) e-commerce teams. Features include Meta Ads tracking, WhatsApp order management, AI insights, and recommendations.
4. Account & eligibility
You must be of legal age and have authority to bind your organization (if applicable). You are responsible for keeping your account credentials confidential and for all activity under your account. You must provide accurate information and keep it updated.
5. Acceptable use
You must not misuse the Service. In particular, you must not:
- Use the Service for any unlawful, fraudulent, or deceptive purpose;
- Send spam, malware, or any malicious content;
- Infringe intellectual property rights of any third party;
- Probe, scan, scrape, or interfere with the security or integrity of the Service;
- Reverse engineer, resell, or redistribute the Service;
- Circumvent any technical limitations or rate limits.
6. Intellectual property
The Service, including all software, documentation, branding, and content we provide, is owned by us and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you subscribe to.
You retain ownership of content you upload. You grant us a limited license to host and process that content solely to provide the Service to you.
7. Payments and subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by the Paddle Buyer Terms.
8. Service level
We work to keep the Service reliable, but we do not guarantee that it will be uninterrupted, error-free, or free of security vulnerabilities. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
9. Suspension and termination
We may suspend or terminate your access for: material breach of these Terms, non-payment, security or fraud risk, or repeated/serious policy violations. Upon termination, you may export your data within a reasonable window before deletion.
10. Liability
To the fullest extent permitted by law, our aggregate liability under these Terms is capped at the fees you paid us (via Paddle) in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing limits liability for fraud, death, or personal injury where required by law.
11. Indemnity
You agree to indemnify us against claims arising from your content, your unlawful use of the Service, or your violation of these Terms.
12. AI features and accuracy
Pulse includes AI-generated insights and recommendations. AI outputs may be inaccurate or incomplete. They are provided for general informational purposes and should not be relied upon as professional financial, legal, or business advice without independent verification. You are responsible for your prompts, how you use outputs, and ensuring you have the rights to any input data.
13. Governing law and disputes
These Terms are governed by the laws of Algeria. Any disputes will be resolved in the competent courts of Algeria, without prejudice to any mandatory consumer protection rights you may have in your country of residence.
14. Changes
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice.
